Abstract:
The focus of this research is 1). How is the practice of rahn among the people
of Selat Remis Village in the perspective of the Sharia Economic Law Compilation
(KHES)? 2). How is the legal review of the Sharia Economic Law Compilation
(KHES) on the practice of pawning among the people of Selat Remis Village?
The aims of this research are to: 1). Knowing the practice of pawning in the
community of Selat Remis Village, Kubu Raya Regency. 2). Knowing the legal
review according to KHES on the practice of pawning in the people of Selat Remis
Village, Kubu Raya Regency.
The research method entirely uses a qualitative paradigm with a sociologicalempirical approach. For primary data sources, there are five informants consisting
of four pawn recipients and one pawnbroker. Data collection techniques were
obtained through interviews, observation, and documentation. Meanwhile,
secondary data was obtained from various sources, namely journals, documents
related to research including KHES as a legal source in analyzing pawn practices.
The argument of this research is that the practice of pawning that occurs refers
more to the habits and traditions that apply in the community. Pawning has long
been practiced in the community in the Remis Strait Village, Kubu Raya Regency.
The practice of pawning vehicles carried out in the Selat Remis Village can be
explained as follows, namely by the arrival of rahin to meet the murtahin intending
to borrow money using a vehicle guarantee with a predetermined period and agreed
upon by both parties. With the passage of time when it is due to return the loan
money borrowed by rahin. The practice of pawning is very easy and practical,
interest-free installment payments, people get funds quickly so they can overcome
their urgent needs.
Based on the data obtained, it can be concluded that 1). The practice of pawning
that occurs between the people of the Remis Strait is only aimed at helping each
other. 2). The practice of pawning carried out by the people of Selat Remis Village
uses the principle of kinship and mutual trust. 3). The practice of pawning carried
out by the people of Selat Remis Village is in accordance with the pillars and
requirements of the KHES.
Suggestions for the pawnbrokers, namely rahin and murtahin, should use a
pawn agreement and witnesses at the time of the pawn contract to be evidence if
there is a dispute between rahin and murtahin in the future. And if there is free time
to find out about pawns that are in accordance with KHES.
