Abstract:
The purpose of this study is: (1) how to prepare resources to find out the
case of sharia pension funds in the pontianak religious court, (2) how to prepare
the infrastuctur to handle aharia pension fund cases in the pontianak religious
court, (3) to what extent the jadges of the religious courts know about the sharia
pension fund case.
This study uses legal research methods and belongs to the type of field
data research or empirical normative legal research. Pontianak Religion. The
technique used to collect data is library research by collecting literature study
legal materials, namely reviewing reference books, legal research results, journals
relevant to this research. Meanwhile, to analyze the data, the researcher used a
qualitative descriptive analysis technique with deductive reasoning logic.
Furthermore, based on the data analysis that the researcher did, a juridical
conclusion was obtained based on Article 20 Paragraph (2) of the Supreme Court
Regulation Number 5 of 2016 concerning the Certification of Sharia Economic
Judges, judges in the Pontianak Religious Court can examine and adjudicate cases
of Sharia pension funds submitted through lawsuits. simple to him. However,
academically, judges in the Pontianak Religious Court are ready to examine the
case of the sharia pension fund which was submitted to the Pontianak Religious
Court.
